Who can register trademark in Poland

As a rule, Trademark in Poland can be registered by both Polish and foreign entities (natural person/legal person). As far as foreigners are concerned, they are entitled to register trademarks in Poland under international agreements, such as TRIPS, Paris Convention for the Protection of Industrial Property, which was ratified by most countries.

Foreign parties from countries outside EU and EEA in proceedings regarding trade mark registration need to be represented by Polish patent attorney, advocate or attorney at law.

 

What can be registered as trademark in Poland                              

Any sign capable of being represented graphically if the sign is capable of distinguishing goods of one enterprise from those of another enterprise, in particular: words, drawings, ornaments, colour arrangements, spatial forms, including the form of goods or their packaging, as well as melodies or other sound.
Costs of trademark registration

Entry fees: 

  • 450 PLN or 400 PLN (electronic registration) - fee for first class of goods or services
  • 120 PLN fee for each next class

 

Fees after acceptance of application:

  • 400 PLN for each class of goods and services - fee for 10 years protection
  • 90 PLN - publishing fee

 

Legal assistance fee - from 250 EUR.

Estimated time of registrationabout 6 months
